These terms and conditions set out how you can use the AmberChes website and by accessing or using our website, you are agreeing to these terms and conditions and the AmberChes Privacy Policy.
By using this site you confirm that you are over the age of 18 and you are acknowledging that the person receiving any delivery of alcoholic beverages from us is over the age of 18.
You agree that you will use this website in accordance with all applicable local, state, national and international laws, rules and regulations and acknowledge that you are aware and comply with all relevant laws regarding the purchase and consumption of alcohol.
We have taken proper care and precautions to ensure that the information we provide on this website is accurate. However, we cannot guarantee, nor do we accept any legal liability arising from or connected to, the accuracy, reliability, currency or completeness of anything contained on this website or on any linked site. We may vary these terms and conditions at any time which become effective upon posting. By continuing to use this website, you consent to be bound by the varied terms and conditions.
Product Dispatch
Orders will be dispatched for delivery within 10 working days of the order and payment being processed unless the product is marked as being a pre-sale or as out of stock in which case it will be dispatched as soon as it becomes available.
Delivery and authority to leave
Delivery cannot be made to anywhere outside of Australia. Delivery dates are for guidance only and do not constitute a guarantee of delivery by such dates and no liability is accepted by us resulting from late delivery.
During checkout, you may provide an authority to leave your order if your delivery address is unattended. Please note, goods cannot be left outside the boundary line of a property. We will not be held responsible for any missing goods when authority has been provided for your goods to be left without a signature.
If the person in attendance at the delivery address is considered by the delivery driver to be under 25 years of age, proof of age will be requested. If suitable proof of age cannot be produced, even if the order was submitted with authority to leave, the person will be advised that the parcel will be redelivered or will be returned to a collection point and can be collected on the production of proof of age identification.
All deliveries that are returned to sender due to incorrect addresses provided by the purchaser or which require redelivery or redirection to a different address may be charged an additional fee.
Contract
Your order is an offer to buy and there will be no contract between us unless and until we accept your order, and in the case of goods to be delivered to you, until we receive payment. At any point up until then we may decline to supply the goods to you without giving any reason. When we accept your order or, in the case of delivery of goods, when we receive payment a contract will be made between us. Our total liability to you for non-delivery of purchased goods is limited to the purchase price of the products. You must notify us of damage caused to goods during shipping within 3 days of delivery and if requested provide photo evidence of the damage caused during transit.
Passwords and logins
You are responsible for maintaining the confidentiality of your passwords and login details and for all activities carried out under your password and login.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Western Australia. Any disputes concerning this website are to be resolved by the courts having jurisdiction in Western Australia.
